Key Takeaways

  1. CalRecycle published the finalized Covered Material Categories (CMCs) list on July 1. While the number of categories remained the same, CalRecycle did not update the recyclability/compostability status of the CMCs. CalRecycle will be updating these determinations annually starting January 1, 2025. CAA is working on guidance materials and ensuring the information is included in the reporting portal when it opens in the first quarter of 2025. The finalized CMC list is available on CalRecycle’s website

  2. CAA’s consultation process to support the development of the Colorado program plan is underway. CAA is seeking input from the diverse group of impacted stakeholders to support the development of a strong and informed program plan proposal.   3. CAA will release its Participant Producer Agreement (PPA) in September. The legal agreement – which will be signed by CAA and each producer – will formalize the roles and responsibilities for both CAA and the individual producer. In addition to the primary terms and conditions, there will be an addendum for each state in which a company has self-identified they will have obligations for as a producer. CAA will continue to provide updates on PPA development and will host additional information sessions on the final agreement for registered producers and their legal counsel following the September release.

  • As the single PRO approved in Colorado and California and the only active PRO in Oregon, producers are required to either individually comply with EPR laws or join CAA. CAA is developing a standard, PPA to best provide harmonized services to all producers that will be consistent for all CAA participants once finalized.

  • The PPA will cover all state programs where CAA is approved. State addenda will be added as needed. The PPA may be updated as well, as needed.  

  • If a producer signs the PPA and is later determined to not be a producer in any state, the producer may terminate their agreement with 60 days’ notice. Each company must review the definition of obligated producer in each state, along with CAA’s guidance on the definition of producer, to determine the company’s obligation. CAA will publish guidance on the definition of producer ahead of the release of the PPA and continue to provide guidance on the definition of producer across states as additional clarity is developed through state rulemaking processes.
